KOM-5A Service Terms

Specific terms for commercial services and K5A Services, supplementing the general Terms of Use.

Language

These Service Terms govern KOM-5A commercial services and K5A Services. For each order, the characteristics, price, duration, trial period, placement or K5A cost shown in the applicable checkout or quote form part of the contract for that service.

If there is a conflict, the service-specific information displayed and accepted for the relevant order prevails only for that order. Nothing in these Terms deprives a consumer of mandatory rights under applicable law.

1. Contract formation and authority of the offer

  • Viewing an offer, indicative price or quote does not by itself form the contract.
  • The service contract is formed when the user completes the required confirmations and KOM-5A technically accepts the order.
  • For Stripe orders, the final checkout is authoritative for amount, taxes, billing interval and details displayed before confirmation.
  • For a K5A Service, the valid server quote is authoritative for the service, target, K5A cost, duration and validity period.
  • Marketing language never replaces the price, duration or characteristics displayed at the point of order.

2. Professional users, consumers and mandatory rights

PRO and ADS are primarily designed for company or professional accounts. The audited technical flow does not by itself prove that every person who could legally qualify as a consumer is mechanically excluded.

  • Where a user acts for professional purposes, applicable B2B rules also apply.
  • Where a user legally qualifies as a consumer, mandatory consumer protections remain reserved.
  • Using a company profile does not remove statutory protection where the user remains a consumer as a matter of law.

3. Prices, taxes, payment and no result guarantee

  • Money payments are processed by the provider shown in the order flow, currently Stripe for the audited PRO and ADS flows.
  • The total price, taxes and currency shown at checkout before confirmation apply to the order. Where required, consumers must be shown the tax-inclusive total price.
  • Payment or use of K5A purchases only the expressly described service; it does not purchase a guarantee of revenue, sales, contacts, clicks, views, ranking or return on investment unless expressly stated.

4. PRO Annex

  • In the source configuration corresponding to this version, PRO checkout is configured at a base amount of EUR 49 excluding tax per month and a 14-day Stripe trial period.
  • The final amount and taxes displayed at checkout are authoritative for the order.
  • After the trial, the subscription renews monthly until cancelled through the available mechanism, subject to mandatory law.
  • The 14-day commercial trial is separate from any statutory withdrawal right.
  • A Stripe subscription-management portal exists in the audited PRO flow and does not reduce statutory cancellation rights.
  • PRO guarantees no particular commercial result.

5. ADS Annex

  • ADS is a one-time paid booking for the placement, zone, mode and duration selected at order time.
  • There is no universal ADS price in these Terms; the amount depends on placement, duration, mode, capacity and booking parameters.
  • Exclusivity applies only to the expressly booked zone and period, not the whole KOM-5A platform.
  • No impressions, clicks, conversions, sales, revenue or performance are guaranteed unless an express quantified commitment appears in the order.
  • ADS content must remain lawful, accurate and compliant with KOM-5A rules and third-party rights.
  • If an ADS service supplied to a consumer begins before an applicable withdrawal period ends, any legally required express request must be collected before early performance.

6. General K5A Service rules

K5A is an internal service and participation unit within the KOM-5A ecosystem. K5A Services allow users to use K5A for defined internal services.

  • K5A is not redeemable for cash and no guaranteed conversion rate to euros, Swiss francs or another legal currency is promised.
  • KOM-5A does not market K5A as a cryptocurrency, financial security, deposit or investment product and promises no interest, yield or appreciation.
  • The K5A cost of a service is the cost shown in the valid server quote accepted by the user.
  • The client cannot authoritatively set cost, duration, actor identity or acceptance timestamp.
  • Activation may be refused for an ineligible target, expired quote, insufficient balance, capacity/scarcity rule, failed security check or another unsatisfied service condition.
  • Fraud, prohibited automation, manipulation, abusive multi-accounting or bypass attempts may result in rejection or suspension.

7. Publication Boost Annex — current offers

  • BOOST_24H: 500 K5A for 86,400 seconds (24 hours).
  • BOOST_7D: 2,500 K5A for 604,800 seconds (7 days).
  • Current technical quote validity is 300 seconds; an expired quote must be replaced.
  • The cost and duration in the accepted quote are the contractual snapshot for that order.
  • Duration means the active service period; it does not mean continuous display to every user.

8. Exact nature of Publication Boost

  • Publication Boost provides additional visibility through KOM-5A’s dedicated rotation/placement mechanism.
  • No minimum views, impressions, clicks, contacts, customers, sales, revenue or organic position are guaranteed.
  • Publication Boost does not buy or alter an organic, PRO or ADS guarantee not expressly included.
  • The user remains responsible for the legality, accuracy and availability of the boosted publication.
  • If the publication becomes unlawful, removed, suspended or ineligible because of the user or content, no automatic full re-credit arises, subject to applicable law.

9. Boost activation, contractual evidence and immediate performance

For new activations governed by v2026-08-26, the Publication Boost flow is intended to collect two separate confirmations before economic admission.

  • First confirmation: the user has read and accepts the applicable K5A Service Terms, including the displayed version and language.
  • Second confirmation: the user expressly requests immediate performance before any applicable withdrawal period ends and acknowledges that the right may be lost after full performance where the law so provides.
  • The server proof must correlate at least the authenticated user, service, target, quote, K5A cost, duration, version, language, confirmations and an authoritative timestamp.
  • A direct request without valid evidence must fail before reservation, debit or activation.
  • No historical acceptance is manufactured or backfilled.

10. Withdrawal, early performance and durable confirmation

Where mandatory law gives a consumer a withdrawal right for a distance service contract, that right remains available under the conditions set by law.

  • Under French consumer law, the period is generally 14 days for distance service contracts, subject to statutory exceptions.
  • Where a consumer requests performance before that period ends, KOM-5A must collect the legally required express request.
  • Loss of the withdrawal right after full performance occurs only under the conditions provided by law; these Terms create no general advance waiver.
  • If a consumer withdraws after lawful early performance begins but before full performance, economic consequences depend on the portion actually supplied and mandatory law.
  • Where law requires a dedicated online withdrawal function, the service flow must provide it separately; this page, a simple link or an email does not replace it.
  • Where law requires contract confirmation on a durable medium, it must be provided within the statutory period and, where required, no later than before performance begins. This Web page alone is not that durable confirmation.

11. Failure, reservation, re-credit and partial performance

  • A quote alone is not a debit.
  • Depending on the K5A Service, K5A may be reserved and then committed according to the command’s technical state.
  • Where activation fails before effective service and the state calls for release, the relevant K5A must be released/re-credited under system rules.
  • Where service has already been fully or partially performed, a full refund/re-credit is not automatic; the remedy depends on state, cause, contract and mandatory rights.
  • A K5A re-credit is not a cash conversion.
  • KOM-5A may correct a manifestly duplicated, erroneous or fraudulent debit/credit without creating an arbitrary confiscation right.

12. Availability, maintenance and suspension

  • KOM-5A uses reasonable efforts to provide services but does not guarantee permanent error-free availability.
  • Maintenance, security incidents, third-party providers, legal changes, force majeure or territorial restrictions may temporarily affect a service.
  • Fraud, prohibited content, security risk, non-payment or rule violations may lead to proportionate suspension.
  • Mandatory rights and remedies for KOM-5A’s own non-performance remain reserved.

13. Evidence, version, language and documents

  • This version is v2026-08-26.
  • FR, EN, DE, IT and AR versions of the same version are intended to have the same legal meaning.
  • For Publication Boost, the language displayed at acceptance must correspond to the locale stored in the proof.
  • Orders may be correlated to commandId, quoteId, placement or payment session to evidence performance and resolve disputes.
  • A material change applying to new orders may result in a new version and new acceptance.
  • A new version does not retroactively rewrite a service already performed.

14. Mediation, complaints, governing law and jurisdiction

  • Complaints should first be submitted to KOM-5A using the legal contact details in the Legal Notice.
  • Where French consumer-mediation rules apply, the competent mediator must be formally designated and its contact details and website communicated to the consumer. KOM-5A must not invent a mediator that has not been appointed.
  • These Terms are governed by French law without depriving consumers of mandatory protections that remain applicable under their circumstances and private-international-law rules.
  • For consumers, jurisdiction is determined by applicable mandatory rules.
  • For professional users, the competent French courts have jurisdiction subject to any contrary mandatory rule.

15. Personal data and document hierarchy

  • Personal-data processing is governed by the Privacy Policy.
  • Cookies and terminal storage are governed by the Cookies & Device Storage Policy.
  • General rules remain in the Terms of Use.
  • Operator identity and mandatory legal information appear in the Legal Notice.
  • In case of conflict: mandatory law, specific order terms, these Service Terms, then the general Terms of Use.
