KOM-5A Terms of Use
General platform-use contract for Web, iOS and Android.

These Terms of Use govern access to KOM-5A and use of its general platform features. The operator's identity and contact details are set out in the Legal Notice. Paid services and K5A Services may also be subject to additional service-specific terms.
Nothing in these Terms limits mandatory rights available to a user under applicable law. Where service-specific terms conflict with these Terms, the service-specific terms prevail only for that service and only to the extent of the conflict.
1. Scope and acceptance
- Simply viewing public pages does not, by itself, constitute contractual acceptance of every KOM-5A feature.
- Where KOM-5A requires acceptance of these Terms to create an account, continue using the service after a material change, or perform a specific action, the user must review and accept the version presented through the applicable mechanism.
- A user must not use a feature where they are not legally permitted to do so in their country or where an account, service or country restriction prevents access.
- These Terms cover general platform use. PRO, ADS, Publication Boost and other K5A Services are also governed by the service-specific terms presented for them.
2. Eligibility, age and accounts
- Users must be at least 16 and have the legal capacity required to use KOM-5A. Where applicable law requires permission from a legal representative, that permission must have been obtained.
- Account information must be accurate, current and must not impersonate another person.
- Users are responsible for keeping authentication methods confidential and must promptly report known or suspected unauthorized access.
- KOM-5A may request information reasonably necessary to verify an account, business, ownership right, authorization or situation presenting a fraud, security or compliance risk.
- Accounts may not be sold, rented, transferred or used to evade a suspension or restriction.
3. User content and the service licence
Users retain the rights they hold in their own content. Users remain responsible for having the rights, permissions and lawful basis required before publishing, uploading or sharing content.
- By publishing content, the user grants KOM-5A a non-exclusive, worldwide, royalty-free licence limited to what is reasonably necessary to host, store, technically reproduce, format, display, distribute within platform surfaces, secure, moderate and provide the features selected by the user.
- This licence does not transfer ownership of user content to KOM-5A.
- The licence ends when the content is no longer reasonably required for the relevant services, subject to temporary technical copies, backups, legal obligations, dispute evidence, security needs or data that may lawfully need to be retained under the Privacy Policy.
- Users must not publish content that infringes copyright, trademarks, trade secrets, image rights, privacy or other third-party rights.
4. Listings, professional users and user-to-user dealings
- Users and professional operators publishing products, services, offers or information remain responsible for accuracy, legality, availability, pricing, taxes, authorizations, safety, delivery, performance, warranties and after-sales obligations.
- A user acting professionally must identify that status where required and provide consumers with legally required information and rights.
- Unless KOM-5A expressly states otherwise for a specific service, KOM-5A is not the seller, buyer, broker, agent, escrow provider, payment guarantor or party to a contract entered into directly between users.
- KOM-5A may provide discovery, publishing, communication, reporting or support tools without becoming a party to a user-to-user transaction.
- The presence of a listing or profile does not mean that KOM-5A guarantees another user's identity, statements, solvency, quality, legality or performance.
5. Prohibited uses, content and activities
KOM-5A may maintain rules stricter than the legal minimum in order to protect the community, platform and partners. In particular, KOM-5A must not be used for:
- unlawful, fraudulent, deceptive, abusive, coercive or harassing activity, or conduct infringing the rights of others;
- the sale, promotion or facilitation of illegal drugs, tobacco or nicotine products, weapons, ammunition, explosives or other dangerous goods prohibited by KOM-5A rules;
- pornographic or sexual content prohibited by platform rules, sexual exploitation, human trafficking or any child sexual abuse material;
- terrorism, violent extremism, threats, incitement to violence, unlawful hate or prohibited discrimination;
- counterfeit, stolen, unsafe, fraudulent, recalled or prohibited products;
- phishing, malware, scams, payment fraud, impersonation or unlawful collection of personal data;
- infringement of intellectual property, confidentiality, privacy or other third-party rights;
- circumvention of sanctions, export controls, territorial restrictions or other applicable legal obligations.
6. Security, automation and platform abuse
- Users must not bypass authentication, access controls, rate limits, country restrictions, eligibility rules, moderation mechanisms or other technical safeguards.
- Bots, scripts, scraping, automated collection, reverse engineering or automated access are prohibited unless authorized in writing by KOM-5A or permitted by mandatory law.
- Users must not artificially create views, clicks, reactions, accounts, rewards, K5A, rankings or engagement signals, or coordinate conduct intended to manipulate the platform.
- Users must not test, scan or exploit vulnerabilities without authorization or use KOM-5A to attack a third party.
- KOM-5A may temporarily limit actions, request verification or block an operation where a credible fraud, security, abuse or technical-error risk is detected.
7. Moderation, notices, restrictions and redress
KOM-5A may moderate content and conduct to enforce platform rules, protect users, respond to notices and comply with legal duties. Measures may include refusing publication, removing or disabling content, reducing visibility, restricting a feature, suspending a service, or suspending/closing an account.
- Illegal or prohibited content and conduct may be reported through available reporting tools or through the abuse contact published in the Legal Notice.
- KOM-5A may use rules and technical tools, including automated or semi-automated means, to detect or prioritize signals of spam, fraud, security events, abuse or potentially prohibited content. Such tools do not guarantee detection of all content.
- Where applicable law requires reasons for a restriction, KOM-5A provides an appropriate explanation and identifies available redress channels.
- Except where immediate action is justified by law, security, protection of others or the seriousness of the conduct, repeated abuse may lead to a warning followed by proportionate suspension. Frequency, severity, consequences and, where reasonably determinable, apparent intent may be taken into account.
- Repeated manifestly unfounded reports or complaints may themselves be restricted where permitted by law.
8. General K5A rules
K5A is an internal service and participation unit used within the KOM-5A ecosystem. These Terms define only general rules; individual K5A Services may have additional contractual terms.
- Depending on available functionality, K5A may be credited through eligible platform activities, transferred between users and used to access selected internal services.
- Under the current model, K5A is not redeemable for cash and no conversion rate to euros, Swiss francs or any other legal currency is guaranteed.
- KOM-5A does not market K5A as a cryptocurrency, financial security, deposit, investment product or product promising returns, interest or appreciation.
- Unless a future feature is expressly authorized under its own terms, users must not sell, purchase, broker, exchange or advertise K5A for money, crypto-assets or off-platform consideration, or present K5A as having an official market rate.
- Users must not obtain K5A through fraud, prohibited automation, abusive multi-accounting, signal manipulation or technical exploitation.
- KOM-5A may correct a manifestly duplicated, erroneous or fraudulent credit and take measures necessary to restore system integrity, subject to the applicable contract and law. This does not authorize arbitrary removal of legitimately acquired contractual rights.
- K5A price, duration, eligibility, activation, expiry, failure and any re-credit for a service are defined by the offer and service-specific terms applicable to that service.
9. Paid services, advertising and visibility services
- PRO subscriptions, ADS services, K5A Services and other KOM-5A commercial services are governed by the Service Terms and the information presented before purchase or activation.
- Price, duration, renewal, cancellation, taxes, withdrawal rights, refunds and performance conditions are determined by the specific terms applicable at the time of purchase.
- A visibility, placement, advertising or Publication Boost service provides only the mechanism expressly described for that service.
- Unless a specific service contract contains an explicit and unambiguous commitment, KOM-5A does not guarantee any number of views, impressions, clicks, contacts, customers, sales, revenue, ranking position or commercial result.
- General advertising language does not replace the price, duration or express commitments presented in the contract for the relevant service.
10. Intellectual property and feedback
- KOM-5A technology, design, software, presentation structures, distinctive signs and platform-owned content are protected by applicable rights and remain owned by their rights holders or used under licence.
- Access to KOM-5A does not transfer rights in the brand, code, graphics or KOM-5A-owned content to a user.
- Where a user voluntarily submits a non-confidential suggestion, idea, feedback item or report about the platform, the user authorizes KOM-5A to use it without royalty to develop, secure, correct or improve products and operations. This does not transfer rights in personal content published through the normal service.
11. Personal data, cookies and notifications
- Personal-data processing is described in the Privacy Policy.
- Cookies, local storage and consent choices are described in the Cookies & Device Storage Policy. Acceptance of these Terms does not constitute consent to optional tracking technologies.
- Service or security notifications may be necessary for account operation. Optional or commercial notifications remain subject to applicable preferences and rules.
- Account deletion does not necessarily mean immediate erasure of every data item: certain information may be retained where law, security, fraud prevention, contractual evidence or a dispute requires it, as described in the Privacy Policy.
12. Availability, service evolution and territorial restrictions
- KOM-5A uses reasonable efforts to provide the platform but does not guarantee uninterrupted, error-free or permanently available operation.
- A feature may be unavailable because of maintenance, outage, a security incident, a third-party provider, a legal change, moderation, eligibility or a territorial restriction.
- Features may evolve, be introduced, changed or withdrawn. A change affecting an already-purchased contractual service remains subject to the applicable contract and mandatory user rights.
- A description of possible future functionality is not a promise that it will be released.
- KOM-5A may restrict or disable capabilities by country where reasonably necessary to comply with legal, regulatory, security, payment, sanctions or operational requirements.
13. Suspension, termination and account deletion
- Users may stop using KOM-5A and use the account-deletion procedure made available.
- KOM-5A may restrict or suspend an account or feature where there is a legitimate reason, including a breach of these Terms, fraud, security, prohibited content, legal obligation, non-payment relating to the relevant service, or circumvention of an earlier measure.
- Where required by law and where it does not prevent necessary urgent action, KOM-5A provides the reason for the restriction and available redress channels.
- Ending an account does not allow either party to disregard obligations that must survive by nature or by law, including obligations relating to amounts due, disputes, intellectual property, evidence, security or lawfully retained data.
- The treatment of a paid service or K5A service/balance following suspension depends on the reason for suspension, service state and applicable specific terms; this clause does not create a right to arbitrary confiscation.
14. Warranties, third-party content and allocation of responsibility
KOM-5A provides the platform with reasonable care appropriate to the relevant service. The platform nevertheless contains user-provided content and offers and depends on third-party technical services.
- KOM-5A does not guarantee the accuracy, quality or legality of every user submission and does not guarantee that another user will perform their obligations.
- KOM-5A does not guarantee that a publication, listing, subscription, advertisement or visibility service will achieve a particular commercial outcome unless expressly agreed.
- Users should exercise reasonable care when dealing with other users and verify important information before entering a transaction.
- Nothing in these Terms excludes statutory warranties, remedies or liabilities that cannot lawfully be excluded or limited.
15. Limitation of liability
KOM-5A's liability is determined under applicable law and the commitments it has actually made. These Terms do not attempt to exclude KOM-5A's own legal or contractual duties where exclusion would be unlawful.
- For consumers, mandatory statutory rights and remedies remain fully applicable.
- KOM-5A is not responsible for non-performance of a contract entered exclusively between users, except to the extent that loss results from KOM-5A's own breach.
- For professional users only, to the extent permitted by law and applicable specific terms, KOM-5A is not liable for indirect loss, loss of profit, opportunity or goodwill that was not a direct and foreseeable consequence of KOM-5A's breach.
- No limitation applies where prohibited by law, including fraud, intentional misconduct or other liability that law makes mandatory.
- Any financial limitation specific to a paid service must be set out in that service's specific terms and is not created by an arbitrary general cap in these Terms.
16. Governing law and disputes
- These Terms are governed by French law.
- The choice of French law does not deprive a consumer of mandatory protections that remain applicable to their situation, including where private international law requires them.
- For consumers, court jurisdiction and dispute-resolution mechanisms are determined by mandatory applicable rules; these Terms do not force a court where the law allows the consumer to use another competent court.
- For professional users, disputes fall within the jurisdiction of the competent French courts, subject to any contrary mandatory rule.
- Complaint, consumer mediation and service-specific redress information for a purchased service is set out in the Legal Notice or Service Terms where applicable.
17. Changes, versioning and interpretation
- These Terms carry a fixed version number and effective date.
- KOM-5A may amend the Terms to reflect legal, regulatory, technical, security or service changes. Material changes are appropriately notified and, where required, subject to renewed acceptance.
- A new version does not retroactively alter a fully performed service or a mandatory right already acquired.
- The official French, English, German, Italian and Arabic versions of the same version are intended to have the same legal meaning. If a translation discrepancy is identified, KOM-5A will correct it through controlled change without reducing mandatory user rights.
- Failure to exercise a right immediately is not a waiver. If a clause is invalid, the remaining clauses continue to apply to the extent permitted by law.
