KOM-5A is currently in PRIVATE TEST PHASE. The platform is free of charge and under active development. By using KOM-5A, you confirm that you understand and accept the conditions below.

1. Test Phase Disclaimer

KOM-5A is experimental and may change at any time. Features may be added, modified, limited, paused, reset, or removed without notice. Availability, performance, and stability are not guaranteed during testing. Participation is voluntary and at your own risk.

2. User-to-User Responsibility

KOM-5A is a platform where users may interact and publish content. KOM-5A does not act as a merchant of record, broker, escrow, or payment guarantor between users. Any negotiation, transaction, delivery, refund, or dispute is strictly between the users involved.

3. No Promises; No Monetary Rewards

Any points, badges, “coins”, “mining”, “levels”, or community indicators shown on KOM-5A are internal participation metrics only. They have NO monetary value, are not redeemable for cash, are not a cryptocurrency, and must not be presented or understood as an investment, a security, or a financial product.

KOM-5A does not promise any profit, earning, or exchange value. Any future evolution (including possible upgrades, advanced community levels, or any technical integration) is speculative and not guaranteed. As an example only, KOM-5A may evaluate broader features if the community reaches a major adoption threshold (e.g. 3,000,000 users), but this is not a commitment and may never happen.

4. Data Protection (Clear Summary)

We treat personal data as sensitive and limit it to what is necessary to operate and secure the platform during the private beta.

  • What we collect: account identifiers (e.g. email), basic profile information you choose to provide, technical data (device/browser), and security logs.
  • Why we collect it: authentication, account protection, abuse prevention, platform stability, and improvement of the test experience.
  • What we do NOT do: we do not sell personal data and we do not provide personal data to third parties for their own marketing.
  • Sharing: limited sharing may occur with vetted service providers strictly to run the platform (e.g. hosting, security, email delivery), under contractual safeguards and only where necessary.
  • Retention: we keep data only as long as needed for the beta operations, legal obligations, and security. We may keep limited security logs to protect the platform and users.
  • Your rights: you may request access, correction, export, or deletion of your personal data, subject to legal and security limits.
  • Cross-border: KOM-5A aims to follow recognized data protection principles (including GDPR and Swiss FADP). Where users are located in other jurisdictions, mandatory local rules may apply.

5. Cookies & Tracking

KOM-5A uses essential cookies for authentication and basic security. Non-essential tracking (such as analytics) should only be enabled with consent where required. For details, see our Privacy Policy.

6. Acceptable Use

You must not use KOM-5A for unlawful, fraudulent, abusive, or harmful purposes. Bots, scraping, attempts to bypass security controls, harassment, hate content, and any prohibited items/services are not allowed. KOM-5A may remove content and restrict access to protect users and comply with law.

7. Limitation of Liability

KOM-5A is provided “as is” during testing, without warranties. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, data loss, or losses arising from user-to-user interactions. Our total liability related to the beta will not exceed EUR 100.

8. Governing Law (Test Phase)

These Terms are governed by French law. Disputes shall be submitted to the competent courts in France, subject to any mandatory rules that may apply depending on the user’s location (including consumer protection rules where applicable).
